We collect the following categories of information: (a) Identity Data — full name, company name, professional title, and corporate contact details provided through our consultation booking forms; (b) Contact Data — email addresses, phone numbers, mailing addresses, and facility location data; (c) Technical Data — IP addresses, browser type, session cookies, and device identifiers collected automatically via standard web analytics; (d) Engineering Project Data — facility square footage, HVAC system descriptions, energy performance data, and project scope briefings submitted voluntarily through our intake forms; (e) Financial Data — billing information processed exclusively through PCI-DSS compliant third-party payment processors (we do not store raw card data).
3. Purpose of Processing
Your data is processed for the following lawful purposes: (a) To provide, manage, and improve our HVAC engineering consulting services; (b) To communicate consultation status, project deliverables, and engineering recommendations; (c) To comply with ASHRAE, OSHA, LEED, Title 24, and other applicable regulatory engineering standards; (d) To analyze website usage patterns and improve our digital service offerings; (e) To send transactional and marketing communications where you have provided express consent. 4. Data Sharing & Third Parties
We engage select third-party service providers including cloud hosting infrastructure (GitHub Pages / Cloudflare), email delivery platforms, and CRM tools — all bound by strict data processing agreements. Professional engineering data may be shared with licensed sub-consultants and peer review engineers strictly for purposes of delivering contracted engineering services, subject to binding confidentiality agreements.
5. Cookies & Tracking
We employ essential cookies required for site functionality, preference cookies that remember your settings, and optional analytics cookies (e.g., Google Analytics) that help us understand site usage in aggregate. 6. Data Retention
We retain client data for the duration of our professional engagement plus a minimum of seven (7) years thereafter to satisfy professional engineering record-keeping standards, tax obligations, and statutes of limitations applicable to licensed engineering services under California Business & Professions Code §5500 et seq. and applicable federal regulations.
7. Your Rights

Terms of Engineering Service

1. Scope of Agreement
These Terms of Engineering Service ("Terms") govern all professional HVAC engineering consulting, mechanical systems design, energy modeling, BAS programming, commissioning, and related technical advisory services ("Services") provided by YZ Tech (YZ Consulting) ("Engineer") to all clients ("Client"). By submitting a consultation request, executing a project agreement, or accessing any deliverable, Client agrees to be bound by these Terms.
2. Professional Standard of Care
All engineering services shall be performed in accordance with the standard of care ordinarily exercised by competent licensed mechanical engineers performing similar services in the same geographic region under similar circumstances. Nothing in these Terms shall be construed to create a warranty of any specific outcome. Engineering judgments are made with the information available at the time of service delivery.
3. Deliverables & Intellectual Property
Upon full payment of all invoiced fees, Client is granted a non-exclusive license to use engineering deliverables (including drawings, specifications, energy models, and reports) solely for the specific project described in the applicable project agreement. YZ Tech retains copyright and all intellectual property rights in all standard details, methodologies, calculation templates, and proprietary analytical tools used in delivering Services. Client shall not reproduce or distribute deliverables for use on separate projects without written authorization.
4. Reliance on Information
Client warrants that all information provided to Engineer — including facility dimensions, existing system specifications, utility data, and occupancy parameters — is accurate and complete to the best of Client's knowledge. Engineer shall not be responsible for errors or omissions in Services resulting from inaccurate or incomplete information provided by Client or third parties.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENGINEER'S TOTAL CUMULATIVE LIABILITY TO CLIENT ARISING FROM OR RELATED TO ANY PROJECT SHALL NOT EXCEED THE TOTAL FEES PAID BY CLIENT TO ENGINEER FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL ENGINEER BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, EVEN IF ENGINEER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Indemnification
Client shall indemnify, defend, and hold harmless YZ Tech and its officers, engineers, agents, and employees from and against any and all claims, damages, losses, and expenses, including reasonable attorney's fees, arising out of or resulting from: (a) inaccurate information provided by Client; (b) Client's modifications to engineering deliverables without Engineer's written consent; (c) use of deliverables for projects other than those specified; or (d) Client's failure to implement engineering recommendations.
7. Payment Terms
Invoices are due net thirty (30) days from invoice date unless otherwise specified in a project agreement. Amounts outstanding beyond thirty (30) days shall accrue interest at one and one-half percent (1.5%) per month (18% annually) or the maximum rate allowed by applicable law, whichever is less. Engineer reserves the right to suspend services and withhold deliverables pending receipt of overdue payment.
8. Dispute Resolution
Any dispute arising from these Terms or any project agreement shall be first submitted to non-binding mediation administered by the American Arbitration Association (AAA) under its Commercial Mediation Procedures. If mediation fails to resolve the dispute within sixty (60) days, the parties shall submit to binding arbitration in Los Angeles County, California under AAA Commercial Arbitration Rules. The prevailing party shall be entitled to recover reasonable attorney's fees and costs.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for any matter not subject to arbitration.
